PhoneClock.in ("the Service") is a cloud-based time tracking and Electronic Visit Verification (EVV) platform designed for homecare agencies, caregivers, and employees. The Service enables GPS-verified clock-in/clock-out, digital signatures, timesheet management, compliance reporting, and related workforce management features.
Accounts are created by authorized administrators on behalf of their organization. By using the Service, you agree to:
You are responsible for all activity that occurs under your account. Administrators are responsible for managing user access within their organization.
The Service is intended exclusively for legitimate business use. You agree not to:
Violation of these terms may result in immediate account suspension or termination.
The Service collects GPS location data at the time of clock-in and clock-out to fulfill Electronic Visit Verification (EVV) compliance requirements. By using the clock-in and clock-out features, you consent to the collection of your location data for this purpose.
Location data is used solely for verifying the time and place of service delivery and generating compliance reports. You may review your recorded locations in your timesheet history.
The Service collects digital signatures from both employees and clients at the time of clock-out. By providing a digital signature, you acknowledge that:
All rights, title, and interest in and to the Service — including its design, code, features, trademarks, and documentation — are and remain the exclusive property of PhoneClock.in. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.
You retain ownership of any data you input into the Service (time entries, signatures, profile information). You grant us a limited license to process this data solely for the purpose of providing the Service.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of scheduled downtime.
To the maximum extent permitted by applicable law, PhoneClock.in and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you have paid for the Service in the twelve (12) months preceding the claim.
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a security risk to the Service or other users.
You may delete your account at any time through the self-service account deletion feature in your settings. Upon deletion, your personal data will be permanently removed in accordance with our Privacy Policy.
We may revise these Terms of Service at any time by posting the updated terms on this page. Material changes will be communicated through the Service or via email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised terms.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.
